Terms of Service



These Terms of Service ("Terms") govern your access to and use of the services and Trig websites (the "Services"), and any information, text, graphics, photos or other materials uploaded, downloaded or appearing on the Services (collectively referred to as "Content"). Your access to and use of the Services is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Services you agree to be bound by these Terms.

Basic Terms

You are responsible for your use of the Services.You may use the Services only if you can form a binding contract with Trig and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction. You may use the Services only in compliance with these Terms and all applicable local, state, national, and international laws, rules and regulations.The Services that Trig provides are always evolving and the form and nature of the Services that Trig provides may change from time to time without prior notice to you. In addition, Trig may stop (permanently or temporarily) providing the Services (or any features within the Services) to you or to users generally and may not be able to provide you with prior notice. We also retain the right to create limits on use at our sole discretion at any time without prior notice to you.The Services may include targeted Content or information on the Services, as queries made through the Services, or other information. The types and extent of targeted Content or Information by Trig on the Services are subject to change. In consideration for Trig granting you access to and use of the Services, you agree that Trig may send you specific content based on your use of the Services.

Privacy

Any information that you provide to Trig is subject to our Privacy Policy, which governs our collection and use of your information. You understand that through your use of the Services you consent to the collection and use (as set forth in the Privacy Policy) of this information, including the transfer of this information to the United States and/or other countries for storage, processing and use by Trig. As part of providing you the Services, we may need to provide you with certain communications, such as service announcements and administrative messages. These communications are considered part of the Services and your Trig account, which you may not be able to opt-out from receiving. Please see the full Privacy Policy for more information.

Passwords

You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password. We encourage you to use "strong" passwords (passwords that use a combination of upper and lower case letters, numbers and symbols) with your account. Trig cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.

Content on the Services

All Content, whether publicly posted or privately transmitted, is the sole responsibility of the person who originated such Content. We may not monitor or control the Content posted via the Services and, we cannot take responsibility for such Content. Any use or reliance on any Content or materials posted via the Services or obtained by you through the Services is at your own risk.We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted via the Services or endorse any opinions expressed via the Services. You understand that by using the Services, you may be exposed to Content that might be offensive, harmful, inaccurate or otherwise inappropriate, or in some cases, information that have been mislabeled or are otherwise deceptive. Under no circumstances will Trig be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Services or broadcast elsewhere.

Your Rights

You are responsible for your use of the Services and for any consequences thereof. Trig will not be responsible or liable for your use of the Content by Trig in accordance with these Terms. You represent and warrant that you have all the rights, power and authority necessary to grant the rights granted herein to any Content that you use.Trig gives you a personal, worldwide, non-assignable and non-exclusive license to use the software that is provided to you by Trig as part of the Services. This license is for the sole purpose of enabling you to use and enjoy the benefit of the Services as provided by Trig, in the manner permitted by these Terms.

Trig Rights

All right, title, and interest in and to the Services are and will remain the exclusive property of Trig and its licensors. The Services are protected by copyright, trademark, and other laws of the United States. Nothing in the Terms gives you a right to use the Trig name or any of the Trig trademarks, logos, domain names, and other distinctive brand features. Any feedback, comments, or suggestions you may provide regarding Trig, or the Services is entirely voluntary and we will be free to use such feedback, comments or suggestions as we see fit and without any obligation to you.Restrictions on Content and Use of the ServicesWe reserve the right at all times (but will not have an obligation) to remove or refuse to distribute any Content on the Services and to terminate users or reclaim usernames. We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce the Terms, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect the rights, property or safety of Trig, its users and the public.Trig does not disclose personally identifying information to third parties except in accordance with our Privacy Policy.You may not do any of the following while accessing or using the Services: (i) access, tamper with, or use non-public areas of the Services, Trig computer systems, or the technical delivery systems of Trig providers; (ii) probe, scan, or test the vulnerability of any system or network or breach or circumvent any security or authentication measures; (iii) access or search or attempt to access or search the Services by any means (automated or otherwise) other than through our currently available, published interfaces that are provided by Trig (and only pursuant to those terms and conditions), unless you have been specifically allowed to do so in a separate agreement with Trig; (iv) forge any TCP/IP packet header or any part of the header information in any email or posting, or in any way use the Services to send altered, deceptive or false source-identifying information; or (v) interfere with, or disrupt, (or attempt to do so), the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, mail-bombing the Services, or by scripting the creation of Content in such a manner as to interfere with or create an undue burden on the Services.

Copyright Policy

Trig respects the intellectual property rights of others and expects users of the Services to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us. If you believe that your Content has been copied in a way that constitutes copyright infringement, please provide us with the following information: (i) a physical or electronic signature of the copyright owner or a person authorized to act on their behalf; (ii) identification of the copyrighted work claimed to have been infringed; (iii) identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material; (iv) your contact information, including your address, telephone number, and an email address; (v) a statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (vi) a statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.The Services are Available "AS-IS"Your access to and use of the Services or any Content is at your own risk. Exclusions

Waiver and Severability

The failure of Trig to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. In the event that any provision of these Terms is held to be invalid or unenforceable, the remaining provisions of these Terms will remain in full force and effect.Controlling Law and JurisdictionThese Terms and any action related thereto will be governed by the laws of the State of Minnesota without regard to or application of its conflict of law provisions or your state or country of residence. All claims, legal proceedings or litigation arising in connection with the Services will be brought solely in Hennepin County, Minnesota, and you consent to the jurisdiction of and venue in such courts and waive any objection as to inconvenient forum. If you are accepting these Terms on behalf of a United States federal government entity that is legally unable to accept the controlling law, jurisdiction or venue clauses above, then those clauses do not apply to you but instead these Terms and any action related thereto will be will be governed by the laws of the United States of America (without reference to conflict of laws) and, in the absence of federal law and to the extent permitted under federal law, the laws of the State of Minnesota (excluding choice of law).

Entire Agreement

These Terms, the Trig Disclaimer and our Privacy Policy are the entire and exclusive agreement between Trig and you regarding the Services (excluding any services for which you have a separate agreement with Trig that is explicitly in addition or in place of these Terms), and these Terms supersede and replace any prior agreements between Trig and you regarding the Services. Other than members of the group of companies of which Trig is the parent, no other person or company will be third party beneficiaries to the Terms.We may revise these Terms from time to time; the most current version will always be at Trig.com. If the revision, in our sole discretion, is material we will notify you via an @Trig update or e-mail to the email associated with your account. Privacy Policy

This privacy statement discloses the privacy practices for Trig.

Information Collection and Use

Trig is the sole owner of the information collected on this site. We will not sell, share, or rent this information to others in ways different from what is disclosed in this statement. Trig collects information from our members at several different points on our Web site.

Account Activation

In order to use some features of this Web site, members must first be provided with, or purchase, and account with Trig, Inc. If you have purchased an individual account you are required to provide your contact information (name and e-mail address). This information is used to set your account, contact you about the topics on our site for which you have expressed interest and to enable members to retrieve lost passwords. If you have been provided an account by your employer during your initial login we will give you the option to change the generic username and password provided to you. It is optional in both cases for the member to provide demographic information (mailing address, position, secondary telephone numbers, etc.).

Session Cookies

Trig uses session cookies to keep a person logged into their account while using the web site. When a member ends the session the session cookie is deleted and is not retained on the member's computer. Members have the option of disabling or not accepting cookies by changing the preferences on their browsers*. If members opt to disable cookies, they will not be able to use our Web site. No personally identifiable information (e-mail address, name, etc.) is collected with the cookies that we set. Accepting cookies while on the Trig site will not put the member at risk for marketing to other sites. *Different browsers have different cookie settings. With Netscape, you can ask the browser to allow, warn you, or completely disable cookies. Internet Explorer has an additional feature where you can specify different settings for different security zones. You can choose to allow Web sites to create cookies for you in your "trusted sites" (like Trig), to warn you before you create them in your local Intranet zone, and to give you an option to never allow them in a "restricted zone." See the "Help" section of your particular browser for more information on working with cookies.

Web Statistics

We use IP addresses to analyze trends, administer the site, track member movement, and gather broad demographic information for aggregate use for reporting and sponsorship purposes. IP addresses are not linked to personally identifiable information.

Sharing

We do not share aggregated demographic information with our partners. We will share aggregated utilization information and system statistics with our clients for utilization reporting purposes. This information is not linked to any personal information that can identify any individual person.

Links

This Web site contains links to other sites. Please be aware that Trig does not claim any responsibility for the privacy practices of such other sites. We encourage our members to be aware when they leave our site and to read the privacy statements of each and every Web site that collects personally identifiable information. This privacy statement applies solely to information collected by this Web site.

Security

This Web site takes every precaution to protect our members' information, and we have security measures in place to protect the loss, misuse, and alteration of the information under our control and the security measures in place meet the requirements of the Health Insurance Portability and Accountability Act (HIPAA).

Surveys

Occasionally, our site requests information from members via Web surveys. Participation in almost all surveys or contests is completely voluntary and the member therefore has a choice whether or not to disclose this information. Information requested may include demographic data (such as zip code and age), but nothing that can identify any individual person will be collected. Survey results will be used for purposes of monitoring or improving the use and satisfaction of this site, and internal program and service development.

Updates

We may also send the member site and service announcement updates. Members are not able to unsubscribe from service announcements that contain important information about the service. We communicate with members to provide requested services and to discuss issues relating to their accounts via e-mail or phone.

Correction/Updating Personal Information

If a member's personally identifiable information changes (such as zip code or e-mail address), or if a member no longer desires our service, we will endeavor to provide a way to correct, update, or remove that the personal data that was provided to us. Members can use the "Settings" link or they can e-mail our Help Desk to change, correct, or remove information.

Choice/Opt-out

Our members are given the opportunity to "opt-out" of newsletters and general communications including e-mail messages. To unsubscribe from mailings, please see the unsubscribe link at the bottom of all email messages.

Notification of Changes

If we decide to change our privacy policy, we will post those changes on our web site so our members are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. If at any point we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we will notify members by e-mail. Members will have a choice as to whether or not we use their information in this different manner. We will use information in accordance with the privacy policy under which the information was collected.

Conditions of Use:

For site security purposes, as well as to ensure that this service remains available to all members, we use software programs to monitor traffic and to identify unauthorized attempts to upload or change information or otherwise cause damage. In the event of authorized law enforcement investigations and pursuant to any required legal process, information from these sources may be used to help identify an individual.

Authorization for Use of Health Information

I and my spouse (if he/she is enrolling in the plan) hereby authorize my employer’s group health plan (the “Health Plan”) to use the following protected health information (PHI) about me for the purpose of notifying me about health-related services provided by or included in the Health Plan and/or health-related services available to enrollees of the Health Plan (that are provided outside of the Health Plan):

· My name and contact information;

· My status as an enrollee in the Health Plan; and

· General information about my utilization of benefits under the Health Plan (which shall not include information about specific claims paid by the Health Plan or about my medical conditions, if any).

I/We understand such PHI may be used for this purpose by the Health Plan, the employer sponsoring of the Health Plan (in its role as Plan Administrator), and Trig Life Services, Inc. (in its role as a business associate of the Health Plan). This authorization for the use of the PHI listed above is valid as long as I/we am enrolled in the Health Plan or until it is revoked.

I/We understand that I/we may refuse to sign this authorization and that such a refusal will not affect my/our ability to enroll in the Health Plan. However, if I/we refuse to sign this authorization I/we may be unable to receive the additional benefits and services referenced above.

I/We understand that I/we may access and copy any PHI used or disclosed under this authorization. I/We understand that a fee may be charged for such copying services.

I/We hereby release the Health Plan, the sponsor of the Health Plan, and the above-referenced business associate of the Health Plan from any legal responsibility or liability for use of the above information to the extent indicated and authorized herein.

I understand that this authorization is voluntary and that I may revoke this authorization at any time by providing the Health Plan with my written notice of such revocation. Such revocation shall not be effective to the extent that action has been taken in reliance on this authorization.
